Communiqué of several associations of magistrates regarding the memorandum for the dissolution of the Crime Investigation Section in Justice

Several magistrates’ associations state, in a joint statement, that they took note with consternation of the incomplete and inaccurate content of the Memorandum adopted by the Government, through which the Minister of Justice Cătălin Predoiu proposed to abolish the Crime Investigation Section in Justice. The Association of Magistrates in Romania, the one of the Judges for the Defense of Human Rights, the National Union of Judges and the Association of Prosecutors ask the Orban Government not to misinform and to inform correctly and completely the the European Union Court of Justice on the reasons and arguments for setting up the respective section. The associations say that the situation created by this memorandum is unjustified and, therefore, inadmissible, given that the Constitutional Court has expressly stated that the section constitutes a legal guarantee of the individual independence of the judges. According to the press release, the Memorandum has a clear partisan character, characterized by superficiality and the exact omission of the essential elements that characterize the Section, including the undeniable positive aspects also noted by the Venice Commission./opopescu
